Welcome to www.detoxorganics.com (the “Site”), owned and operated by Detox Superfoods LLC ("we," "our," "us"). By accessing or using our Site, you agree to these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not access or use the Site.

1. Eligibility

By using this Site, you affirm that you are at least 18 years of age or have the consent of a parent or guardian to use the Site and make purchases.

2. Changes to Terms

We may modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site constitutes acceptance of the updated Terms.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your information. Please review it carefully before using the Site.

4. Use of the Site

  • Refrain from engaging in any activity that disrupts or interferes with the Site’s functionality.

5. Products and Orders

5.1 Product Information

We strive to provide accurate descriptions of our products. However, we do not warrant that product descriptions, images, or other content on the Site are error-free, complete, or current.

5.2 Pricing

All prices are listed in U.S. dollars. Prices are subject to change without notice. Promotional discounts and offers are limited to the time specified.

5.3 Order Acceptance

We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or descriptions, or suspected fraud.

5.4 Shipping and Returns

Shipping: Most orders ship within 1-2 business days. Shipping times may vary depending on your location and selected shipping method.

Refunds:

  • If you purchase a “Bundle” and decide to return only part of the bundle, please understand that the product you keep is charged at regular price, not the discounted “bundled price.”

How do I request a refund? In order for a refund to be processed, a request must be sent to our Customer Support team at hi@detoxorganics.com.
Please include your order number and feedback to let us know why the product wasn’t the best fit for you. We know we can always improve, so we appreciate your point of view!
When our team receives your refund request, they will respond in email to confirm order details.

If you’re shipping unopened products back to us, please include your name, order number, and email address with the return package. Without it, we will not be able to identify your return to process a refund. We do not require you to send any opened product back to us because, well, it’s unsanitary.

When can I expect my refund?

  • If you don’t have products to ship back, we will process your refund immediately, and it usually takes 5-7 business days to reflect on your statement.

  • If you are sending any unopened products back to us, once it has been verified by our warehouse team, a refund will be processed within 5-7 business days.
    Again, give it some time to appear on your statement. It’s out of our control once we issue the refund, and it can take a bit longer at times.

6. Intellectual Property

All content on the Site, including text, images, logos, graphics, and software, is the property of Detox Superfoods LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.

7. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation of the Site.

8. Limitation of Liability

To the fullest extent permitted by law, Detox Superfoods LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or its content. Our total liability for any claim arising out of these Terms or your use of the Site shall not exceed the amount you paid for products purchased through the Site.

9. Indemnification

You agree to indemnify and hold Detox Superfoods LLC harmless from any claims, losses, damages, liabilities, and expenses (including attorneys’ fees) arising out of your use of the Site, violation of these Terms, or infringement of any rights of a third party.

10. Arbitration Agreement and Class Action Waiver

10.1 Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or your purchase or use of products shall be resolved exclusively through binding arbitration. This agreement to arbitrate applies to all claims, regardless of the legal theory.

10.2 Class Action Waiver

You agree that arbitration will be conducted on an individual basis only and not as a class, collective, consolidated, or representative action. The arbitrator may not consolidate claims from multiple parties or preside over any class or representative proceeding.

10.3 Arbitration Rules

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this agreement. Arbitration shall take place in Scottsdale, Arizona, or another mutually agreed location.

10.4 Opt-Out

You may opt out of this Arbitration Agreement by providing written notice within 30 days of your first use of the Site or purchase of products. To opt out, send a written notice to Detox Superfoods LLC 125 S Union St., Olean, NY 14760.

11. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Scottsdale, Arizona.

12. Termination

We reserve the right to terminate or suspend your access to the Site, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Promos and Sales

Promo codes, sales, coupons, and other discount offers on any Detox Organics product or service are not valid on subscription-based orders (auto-ship). We reserve the right to cancel or hold any purchase using a promo code, coupon, or any other sale or discount offer made on auto-ship. Promo codes, coupons, sales, and discounts are on select items only. Only one (1) promo code may be redeemed per user account per promotion. You must be at least 18 years old to use a promo code and/or any type of discount offer. Promo codes cannot be used in conjunction with any other discount offer, promo code, or coupon, unless specified. Even if an offer is accepted at checkout, your order will be reviewed and we reserve the right to decline your purchase if we find that it violates any Terms and Conditions.

14. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Detox Superfoods LLC regarding your use of the Site. Any failure by us to enforce any provision of these Terms shall not be deemed a waiver of that provision.
